Restrictive

Cambodia allows foreign ownership of condominium units but prohibits foreign ownership of land. The rules around floors, building quotas, and border zones are central to any foreign purchase.

  • Foreigners CAN own private units (condos/strata) on the first floor and above, under the 2010 Foreign Ownership Law
  • Foreigners CANNOT own ground-floor or basement units, common areas, or land
  • Foreign ownership is capped at 70% of the total private-unit surface area in any single co-owned building
  • Foreigners cannot own units in buildings within 30 km of a land border, with limited exceptions
  • Land ownership is reserved for Khmer citizens or entities at least 51% Cambodian-owned (Constitution Article 44, Land Law)
  • Land can be accessed indirectly via long leasehold (up to 50 years, renewable), a Cambodian-majority company, or a licensed-bank trust under the 2019 Trust Law
  • Nominee land arrangements (using a Cambodian to hold land for a foreigner) are illegal and unenforceable
